ATP hits back at Dash and Zeitgeist over Jabberwocky In a statement on Friday, the live firm claimed that ticketing platform Dash Tickets had changed the terms and conditions of sale listed on its website in an attempt to avoid responsibility for providing refunds. And that PR firm The Zeitgeist Agency, which stated last week that it was suing ATP over unpaid fees, was sacked "for doing a disappointingly substandard job". As previously reported, the two day event was due to begin on Friday, but was cancelled last Tuesday afternoon due to poor ticket sales. "In the past ATP has weathered losses such as this and gone on with the show, taking huge direct financial blows as an independent company", said ATP boss Barry Hogan in a statement announcing the cancellation. "But on this occasion, with an event of this scale and the high production costs that come with it - if we had gone ahead, it would have 100% been the end of ATP. We do not take this decision lightly and it was the hardest we've ever had to make". Shortly after that announcement, Zeitgeist issued its own statement revealing that it had launched legal action over unpaid fees in July, saying that "[ATP parent company] Willwal's representatives have revealed to us in writing that they used the funds destined for us in order to protect payments for venue and artists, rather than settle essential and agreed amounts to our company". Then Dash Tickets informed ticket holders that it was also taking legal advice over ATP's statement, in which the promoter had said that "refunds will be available to all customers at the point of purchase". This, Dash said, was not in line with its terms and conditions, which put the onus for refunding on the promoter. The ticketing firm also said that it had already passed all funds over to ATP, and insisted that it had merely been a technology provider, rather than a traditional ticket agent. Responding to these statements from two of its suppliers, ATP said in its new announcement on Friday: "The claim that ATP has received all the funds for Jabberwocky is not true. We have not received a payment from Dash for more than two months. Any advances from the sales before that went straight into event costs such as various artist fees and venue hire. But we have not received all the funds for Jabberwocky sales from Dash, and for them to make statements on their social media saying we have in fact received all these funds is simply not true. If that was the case, then we would not have struggled to stage the event". On the subject of Dash's terms, ATP says: "As per their terms and conditions at the time Jabberwocky went on sale, we were always under the impression that in the event of a cancellation, all refunds would be processed by Dash, as the funds were sent directly to Dash's PayPal account - not ATP's. Since then, Dash's terms and conditions have changed on their website without our knowledge, well after Jabberwocky was on-sale, in an attempt to reflect no responsibility for the payments accepted into their PayPal account". The accusation that Dash changed its terms and conditions without informing its clients is a pretty serious one that could certainly be damaging to the ticketing provider if proven true. Though it may well transpire that Dash's T+Cs aren't so relevant anyway, given that ATP is unlikely to make any refunds directly, meaning those who bought their Jabberwocky tickets from the event's main ticketing outlet will turn to their banks and credit card providers to get their money back. And, one ticketing expert told CMU, it is Dash who the payment provider firms will most likely hit out at, once all those refunds have been made, because they don't have a direct relationship with ATP, even if, as Dash claims, that's where most of the money went. Attempts to contact Dash for comment have not been returned, and the company has said nothing else publicly since ATP's latest statement was published. On the subject of Zeitgeist, ATP continues: "The PR firm we originally engaged for Jabberwocky, Zeitgeist, felt it was necessary to announce to the world that they were taking legal action against us. What they neglected to mention was that we actually terminated their services for doing a disappointingly substandard job on the Jabberwocky press campaign and are in a legal dispute with them over the amount owed". The promoter adds: "When we dismissed them, they also started circulating rumours that Jabberwocky was in trouble, which of course did not help with advance sales and unfortunately, became a self-fulfilling prophecy". In response to that, Zeitgeist's Jamie Stockwood told CMU: "It's good of ATP to finally respond on this matter. It would appear that our company, the ticketing agency, all suppliers and all the disappointed fans were wrong about Willwal Ltd. Even their partners have distanced themselves from the situation. This is a matter for the courts now but we are sure the overwhelming recent media coverage and ongoing investigations will ensure the good will out". In reference to the event partners mentioned by Stockwood, ATP's statement concludes: "We are devastated the event didn't happen. It has always been a dream to finally get together two of our long time friends - Pitchfork and Primavera - and Jabberwocky was to be this dream realised". Police complain to BBC over Cliff Richard investigation leak In a statement last week, South Yorkshire Police said: "The force was contacted some weeks ago by a BBC reporter who made it clear he knew of the existence of an investigation. It was clear he was in a position to publish it. The force was reluctant to cooperate but felt that to do otherwise would risk losing any potential evidence, so in the interests of the investigation it was agreed that the reporter would be notified of the date of the house search in return for delaying publication of any of the facts". It continued: "Contrary to media reports, this decision was not taken in order to maximise publicity, it was taken to preserve any potential evidence. South Yorkshire Police considers it disappointing that the BBC was slow to acknowledge that the force was not the source of the leak. A letter of complaint has been sent to the Director General of the BBC making it clear that the broadcasters appears to have contravened its editorial guidelines". In response, the BBC said in a statement: "A BBC journalist approached South Yorkshire Police with information about the investigation. The BBC agreed to follow normal journalistic practice and not to publish a story that might jeopardise a police inquiry". As previously reported, Cliff Richard's Berkshire home was searched by police last week, in relations to allegations of the sexual assault of a boy under the age of sixteen at a Christian faith rally in 1985. The singer has denied the claims, saying that they are "completely false", and adding that he will "co-operate fully" with the police investigation. -------------------------------------------------- Pirate Party MEP details prison visit to Pirate Bay founder "If you don't constantly insist upon your rights, you will be denied them", Sunde told Reda. On this, she writes: "Repeatedly, he had to remind the guards that they're not allowed to open confidential mail he receives from journalists. His alleged right to an education or occupation during his jail time in practice amounted to being given a beginners' Spanish book". The MEP also echoes Sunde's view that prison and copyright are very similar, stating that in both "there is a lack of transparency and the people in power profit from the fact that the average person doesn't pay a lot of attention to the issue". Though, while both Sunde and Reda remain critical of copyright law, that doesn't mean the former is still a champion of the file-sharing platform he helped create. Indeed, the Pirate Party rep reveals that Sunde is not a fan of what the website he helped to set up, and which landed him in prison, has now become, saying: "In Peter's eyes, The Pirate Bay has run its course and turned into a commercial enterprise that has little to do with the values it was founded on. Nowadays, the most important battles for an open internet take place elsewhere, he says, noting that the trend towards centralisation is not limited to file-sharing". Sunde is now apparently hoping to spend most of the remainder of his sentence under house arrest rather than in prison, so that he is able to spend time with his sick father. Spotify launches in Canada A spokesperson for Spotify told CMU: "We have started sending out invitations to users who have signed up on the online waiting list for Spotify. Over the coming months we will be gradually inviting users on to the service in an attempt to systematically scale Spotify in the most manageable way possible". They added: "We are taking our time to make sure that the service we launch in Canada is the best possible experience for all music fans with the comprehensive local content and great local music curation". Spotify revealed plans to launch in Canada last month. Jonathan Ross invited back for 'one-off' Radio 2 stint It's only a "one-off stint" on the station for Wossy mind, with him hosting Wright's afternoon show from 26-29 Aug, which leaves little time for any shit on the scale of the 'Sachsgate' scandal to go down. Yet that said, there is still time (literally), I guess. Ross, of course, attracted a whole lot of criticism - and 42,000 listener complaints - back in 2008, when the BBC aired a show in which he and then-also-a-Radio 2 presenter Russell Brand phoned 'Fawlty Towers' actor Andrew Sachs, leaving him a series of lewd voicemails of the kind an elderly man might not (and accordingly did not) appreciate. The incident - and a resulting anti-Ross/Brand campaign in the Daily Mail - led to Brand's resignation, a £150,000 OfCom fine for the BBC, and a three-month suspension for Ross, who, though he did return to his Saturday morning slot for another year and a half, then quit in 2010 for a chat show on ITV. A BBC rep has said: "Jonathan is returning for this one-off stint of holiday cover for Steve Wright. There are no plans to bring him back permanently. Jonathan is an experienced and talented broadcaster who presented on Radio 2 for ten years and was very popular with our audience. He is standing in for Steve Wright while he is on holiday and we hope listeners will enjoy listening to him on the network for these few days". Gene Simmons apologises for comments on suicide Asked by the website if he still gets on with former Kiss members Ace Frehley and Peter Criss, Simmons replied: "No, I don't get along with anybody who's a drug addict and has a dark cloud over their head and sees themselves as a victim". Potentially libellous statements aside, he quickly went off on a tangent, saying: "For a putz, 20 year old kid to say, 'I'm depressed, I live in Seattle'. Fuck you, then kill yourself. I never understand, because I always call them on their bluff. I'm the guy who says 'jump!' when there's a guy on top of a building who says, 'That's it, I can't take it anymore, I'm going to jump'". He then went on to suggest that most of the hypothetical people he finds on hypothetical rooftops are faking their distress for attention. Criticism of the comments blew up in the wake of the death of comedian Robin Williams as the result of suicide, although the interview was actually published before that news broke. But after several US radio stations banned Kiss from their playlists in protest at the remarks, Simmons wrote in a statement on Facebook: "To the extent my comments reported by the media speak of depression, I was wrong and in the spur of the moment made remarks that in hindsight were made without regard for those who truly suffer the struggles of depression. I sincerely apologise to those who were offended by my comments. I recognise that depression is very serious and very sad when it happens to anyone, especially loved ones. I deeply support and am empathetic to anyone suffering from any disease, especially depression". However, he continued: "I have never sugar-coated my feelings regarding drug use and alcoholics. Somewhere along the line, my intention of speaking very directly and perhaps politically incorrectly about drug use and alcoholics has been misconstrued as vile commentary on depression. Unkind statements about depression was certainly never my intention. Fully, you will know that and I do not intend to defend myself here and now, by listing the myriad charities and self-help organisations I am involved with. Rather, I simply want to be clear that my heart goes out to anyone suffering from depression and I deeply regret any offhand remarks in the heat of an interview that might have suggested otherwise". In another interview last week, Simmons told immigrants to the US that they should "learn to speak goddamn English", and then accused The Black Lips of having a racist name after they accused him of misogyny. Manic Street Preachers cancel first V Festival performance In a statement issued via Twitter, the band said: "After five hours on the runway at Budapest Airport following Sziget Festival [on Friday], MSP were informed the BA plane they were on would not fly. The band made every endeavour to get back to the UK in time to play. The band apologise to their fans at V Chelmsford for the cancellation". Aphex Twin blimp appears over London. Why? No idea. Staff apparently told music marketing type Jack Cooper, who was attending the London Craft Beer Festival at the venue, that the blimp was there to promote "an event that's been cancelled", adding later that the person tending to the blimp said that it was there for "just marketing, nothing else". Less imaginative people suggested that Richard D James would be DJing at the beer festival, or something. But he didn't (obviously). And then people started noticing that his logo had been stencilled on the Radio City Music Hall in New York too. What could it mean? How are we supposed to sleep at night without knowing? Let's not!
