US National Association Of Broadcasters opposes changes to ASCAP and BMI consent decrees As previously reported, the DoJ is currently reviewing the 'consent decrees' that govern how ASCAP and BMI licence songs for public performance in the US. This comes as some publishers, Universal and Sony/ATV in particular, push to be allowed to withdraw their digital rights from the collective system in order to negotiate rates with digital services direct, while continuing to licence broadcast, live and such like collectively. Both the societies support a move towards publishers being able to pick and choose which services they licence through the collective system. They also say that they should be allowed to licence mechanical rights as well as performing rights - something ASCAP noted in its submission last week that the third, smaller collecting society in the US, SESAC, is allowed to do should it so wish, as it is not governed in the same way by the consent decrees. However, in a submission to the Department Of Justice's Antitrust Division on Friday, the NAB said that the consent decrees should remain unchanged to prevent anti-competitive behaviour by the music publishers. They also held SESAC up as an example, though for their part as an organisation operating without consent decree control that, in the broadcasters' opinion, shows why things shouldn't be allowed to change for the bigger copyight groups. The trade body said: "The aggregation of rights gives the PROs tremendous market power, which in the absence of the consent decrees would allow the PROs to extract supra-competitive pricing for their licenses. Radio and television broadcasters lack control, in certain instances, over the particular songs that are broadcast. Even with respect to programming created by broadcasters, each of the PROs has aggregated such a large repertory that there is often no practical way to avoid playing music licensed by each of the PROs". Arguing that withdrawing certain service types from the collective system would allow publishers to discriminate against different licensees, it added: "The major music publishers with substantial catalogues have essentially the same market power as the PROs because their catalogues do not compete with one another, and each has aggregated a large enough number of songs from individual songwriters as to make the licensing of their catalogues indispensable for broadcasters. If allowed to circumvent the consent decrees, those publishers will abuse their market power to extract supra-competitive rates, terms, and conditions from the blanket licensees they choose to target". Although the NAB is best known for representing the traditional FM and AM broadcasters, many of its members have ambitions in the streaming music domain also, so have a similar attitude towards digital licensing as Pandora, which is opposed to the flexible opt outs from collective licensing. The NAB also called for greater transparency on the part of ASCAP and BMI within the existing system, saying: "Lack of meaningful access to such information has increased transaction costs and hindered licensing activities - both direct and collective. Repertory transparency would allow licensors, licensees, and the rate courts to better understand the rights that are being licensed and their value". Both Universal Music Publishing and Sony/ATV are yet to make their own submissions to the DoJ review, though these are expected shortly and are likely to echo those of ASCAP and BMI. | ||||||||||||||||||||||||||||||||||||||||||||||||||
Musicians' Union publishes buskers' guide to Liverpool 'The Guide To Busking In Liverpool' comes two years after the MU successfully opposed the introduction of licensed pitches for busking in the city. It has been published jointly with Liverpool City Council, the Keep Streets Live Campaign and the Business Improvement District. Says the MU's Regional Officer for the North of England, Morris Stemp: "The aim of the guide is to foster a vibrant street culture which allows for spontaneity whilst at the same time making provision for constructively resolving any issues that may arise using existing statutory powers, and is an example I anticipate many will want to follow. It also blows apart the myth that busking is in some way illegal". He added: "This is in stark contrast to some less pragmatic authorities and councils, where heavy handed regulation and over-zealous bureaucracy stifle self-expression. Buskers in Liverpool now have a guide that will help nurture music and other art forms on the streets, with all the benefits this will bring to the city, to buskers and to wider society". In part, that was a little swipe at Camden Council, which has imposed restrictions on busking in the London borough. Gough said in a statement: "I'm thrilled to be taking on Future's music portfolio with world leading brands like MusicRadar, Guitarist and Computer Music. I'm looking forward to taking them to a new level in the market place in the UK and internationally". -------------------------------------------------- Report claims sexism and racism in music videos is "endemic", calls for compulsory age ratings The report is published by Rewind & Reframe - a joint project between charities The End Violence Against Women Coalition, Imkaan and Object - which has already called on the BPI and David Cameron to support online age ratings, and on Vevo to "properly" enforce its rules on hosting explicit and harmful content. Since these letters were published, the government has, as previously reported, asked the BPI and British Board Of Film Classification to work on a voluntary pilot scheme for applying age ratings to online music videos. And from October physically released music videos will have to be submitted for classification, where they previously would not. This report is seemingly a move to lay on more pressure as work on the pilot scheme slowly continues, with the report's author, Dr Maddy Coy, saying in a statement last week: "This paper sets out what is known about music videos - that sexist and racist stereotypes are endemic - and that this can be related to harm in the real world". Whether age ratings on videos will actually have any effect, particularly online, is a matter up for debate. And, of course, apply age ratings to videos doesn't mean that they will be less sexist or racist. Mystery musician Lewis finally found As previously reported, Lights In The Attic re-issued the 1983 album 'L'Amour' by Lewis earlier this year. The label knew very little of the record, let alone who or where the man behind it actually was. Nonetheless, the company vowed to store his share of royalties on the off chance he could be found. After the album and the story behind it began to spread, a second record emerged, 'Romantic Times', which LITA is due to release later this month, only adding to the myth and mystery. But with word spreading, it was only a matter of time before someone's memory was jogged for information. And it was. Although it had been feared that he was dead, a friend of the musician got in touch and revealed that Wulff is alive and well and living in Canada. "Randy had no idea about the recent interest in his old records and didn't seem to care in the slightest", the label explains a blog post. "We had a [cheque] for him but he wasn't interested. We brought him CDs and LPs of 'L'Amour'. He took a look, impressed ('nice'), and smiled, recalling a number of positive stories from back in the day. Then handed back the CD, saying it was for us and kindly declined keeping it. Randy simply wanted to look forward with both his life and music and had no interest in any celebrity or financial gain having to do with the albums". It continues: "He told us over and over again, 'That was a long time ago' and that we should 'have a ball' with the re-issues. When we mentioned that we'd been looking for him for years, he was surprised, responding that he's been right there all along and shops for groceries at his neighborhood store". Despite this, the company said it didn't feel right not sharing the revenues from these two releases with him, even if he doesn't want the money. As a result, the records will not be repressed once they've sold out, and Wulff's royalties will continue to be set aside, just in case he does decide he wants them. Police stated that they suspect a drug overdose was the cause, having found drugs and drug paraphernalia near the body, though a cousin of the producer later claimed that complications relating to a blood clot in his leg was the cause. An autopsy in the days after Harden's death proved inconclusive, meaning that medical examiners had to wait for the toxicology results to be returned. Last week they confirmed that it had been a drug-related death. -------------------------------------------------- Rick Parfitt doing fine following minor operation As is detailed in an official FB post from Status Quo HQ, Parfitt was taken ill whilst on the road in Croatia, and flown back to London via air ambulance. Later tests revealed that a graft transplanted during Rick's quadruple heart bypass of 1997 had become "furred", which was causing his condition. This was remedied with the insertion of a stent, or mesh tube, with Parfitt said to be doing fine following the operation. Confirming that, as thing stand, Parfitt and band will be back on rockin form in time for gigs at Worksop's Clumber Park (15 Aug) and Norfolk's Holkham Hall (23 Aug), manager to the Quo Simon Porter adds: "We are all obviously delighted that Rick has made such rapid progress, especially as the band is shortly to unveil another exciting and innovative new project, details of which will be announced in the next couple of weeks". -------------------------------------------------- Blazin Squad comin back? It then uses that as a springboard to delve further into the life and music of the musician himself. Boardmasters final day cancelled due to "extreme weather conditions" Initially it was announced that the opening of the third day of the annual surfing themed event would be delayed. However, as conditions failed to improve, the event day was called off at 12.30pm. The day was due to be headlined by Bastille, with Peace, George Ezra and 2manydjs also on the bill. Announcing the decision, organisers said: "Our guests, staff and performers' safety is our main concern and we have decided that the magnitude of the conditions is too severe for the arena site to be opened". Lady Gaga talks new "alluring and ready for sex" fragrance You can't argue with numbers like that, which will be why Gaga is bringing out another bottle of perfume at some point in the near future, which she has decided to call 'Eau De Gaga'. Yes, that is a pretty terrible name. Anyway, having announced the thing on Instagram last week, Gaga fielded a few questions from fans about the scent on Twitter. Clarifying that, like 'Fame', 'Eau De Gaga' is a unisex smell, Gaga said that it is "inspired by the adventurous woman and the man who loves her". So, not hookers and semen, like the last one. No, in fact, she went on, "the base consists of sparkling water, lime, leather. Three things I use every day. A very clean expensive scent". Another fan asked if she could make a "100% male version", which seems like an odd request. "You don't need it with this fragrance", she responded. "It is an extremely sexy and arousing smell for all genders. Alluring and ready for sex". The perfume is ready for sex? I don't know what that means.
